The Vanderburgh County Public Defender Agency has been appointed to represent you in your case.  If you are out of custody, you MUST call the Public Defender’s Office at 812-435-5900 immediately.  A specific attorney will be assigned to your case as soon as possible.  If you do not make bond you will be notified of the name of your assigned attorney.  If you make bond and do not know which attorney has been assigned to your case you may contact the Agency at 812-435-5900 or go to https://public.courts.in.gov/mycase and find out who your attorney is.

7-STEPS TO PROCESSING A COMPLAINT OF DISCRIMINATION

1. FILING A COMPLAINT

WHO - Any person claiming to be a aggrieved by a discriminatory practice or act contrary to the provisions in the City-County law may file a complaint with the City-County Human Relations Commission.

WHEN - A complaint must be filed within 90 days from the date of occurrence of the discriminatory act (except in housing cases).

A complaint alleging a discriminatory housing practice must be filed within 1 year after the discriminatory act has occurred.

HOW - Complaints may be filed either by personal delivery, US Postal Service mail, or FAX. If needed, the HRC staff will provide assistance in drafting and filing the complaint. The complaint must be in writing and signed under penalties of perjury.

2. INVESTIGATION

The HRC investigator's job is to collect and summarized the evidence. The investigator must collect the best evidence available for each side. Thus,you may be asked to supply documents that support your position.

The investigator will seek information to compare the treatment given the Complainant to that treatment given to other similarly situated individuals or groups.

Three may be an attempt to discuss the issues and settle the case. Your lawyer is welcome to participate in the investigation, but a LAWYER IS NOT REQUIRED.

The HRC investigator may also request that a test be performed during the investigation. Testing is a controlled method to determine differential treatment in the quality and content of information and/or services given in order to discovery any discriminatory practices.

NOTE: You may have other rights or causes of action that do not fall under the jurisdiction of the City-County Human Relations Commission. If you feel you do, you should contact a lawyer.

3. EXECUTIVE DIRECTOR'S DETERMINATION

If no settlement has been reached, the facts and recommendations are presented to the executive director who reviews the material and makes a determination whether there is probable cause to believe that an illegal act of discrimination occurred. The complainant has 15 days to ask for reconsideration of a 'no probable cause' finding.

4. CONCILIATION SETTLEMENT

If probable cause IS found, a formal attempt to resolve the case will be made. If settlement is achieved, a written Consent Agreement will be issued for signature by all parties. The agreement is then submitted to the Human Relations Commission for consideration. When approved, a Consent Agreement has the same affect as a Final Order.

5. PUBLIC HEARING

If settlement fails, the case is tried at a public hearing. Respondent must hire its own private attorney to represent its claim. The burden of proof is on the complainant. A Hearing Officer presides at the public hearing.

Proposed findings are issued by the Hearing Officer and submitted to the HRC. Either party has 10 days to file objections to the recommended findings. An oral argument on objections may be held before the full Commission.

6. FINAL ORDER

A Final Order by the Commission is binding. Either party may seek judicial review.

7. REMEDIES

If the Commission finds discrimination has occurred, a Final Order may include a cease and desist order and require further affirmative action that would eliminate discrimination. This might include reinstatement to a job, monetary relief where evidence showed there was some resulting loss, making a house or apartment available, and/or validating selection devices. Reasonable attorney's fees and costs may be awarded to the prevailing party in housing cases.

Evansville's Climate Action Plan was developed in 2020 in partnership with Indiana University's Environmental Resilience Institute, and our local community stakeholders and citizens.

It targets strategies in transportation, buildings and energy, waste, and greenspace and agriculture that will reduce our greenhouse gas emissions and improve our resilience to climate impacts.

The Evansville Fire Department Fire Prevention Division would like to thank you for reporting a concern about a potential fire hazard.

Thank you for making your community safer by reporting your concerns.

Complaints should be related to fire hazards/fire code violations regarding places of assembly or commercial properties. The Evansville Fire Department’s Fire Marshal’s Office only has jurisdiction within the City of Evansville. Therefore they will only respond to complaints regarding properties located within the city limits of Evansville.

If you have a pending case, you should make arrangements to meet with your Public Defender in person as soon as possible.  To protect you while your case is pending, below are some practical suggestions which you may wish to follow:

* Do not discuss your case with anyone other than your Attorney.

Inmates, co-defendants and sometimes associates are looking for opportunities to provide information to the police or prosecution to help their own cases or to get themselves out of trouble. They frequently will wind up testifying against you.

* Do not write letters to the police, prosecutor or judge about your case.

These letters will often times become evidence against you at trial or will lead to the discovery of evidence that can be used against you.

* Do not speak to or give statements to the police about your case.

If you decide to speak with the police, it should only be after you and your Attorney have determined that it is in your best interest to do so. Any agreement providing for your cooperation should be in writing. You should not try to represent yourself in this regard.

* Do not contact the alleged victim or the state’s witnesses either directly or indirectly.

Contact with the alleged victims may constitute a new criminal offense with which you could be charged. Furthermore, contact with victims or witnesses will probably be communicated to either the judge or jury and may appear as though you are trying to influence the witness.

* If you make bond.

Contact the Public Defender's Office immediately to give them an address and phone number where you can be reached so you and your Attorney can meet to discuss your case. If your Attorney is not available, you may leave a message with a secretary.

* If you are incarcerated and unable to make bond.

Our office makes every effort to make contact with you within 72 hours of being appointed to your case. Generally, the initial contact is with a trained Paralegal. Please cooperate with this person so that we can begin preparing your case. Your Attorney will meet with you as soon as they can. Designate a relative to act as a contact person with your Attorney. This is an effective way to communicate non-confidential information and will reduce the need for timely jail visits.

* You have a right to a speedy trial.

You must affirmatively exercise your right to a speedy trial. If you wish to have a speedy trial, you should communicate that to your Attorney on your first visit. If you are incarcerated, a speedy trial request requires that your trial commence within 70 days from the date your request is presented to the Court. However, certain delays including Court congestion may extend this time limitation. Consult with your Attorney to determine if requesting a speedy trial is in your best interest.

* Maximize your time with your Attorney during your visits.

You need to assist in the preparation of your defense. If you have witnesses, be sure to have their names and a way to contact them. If there are items of evidence (letters, photos, etc.) which may be important to your defense, advise your Attorney or the Paralegal of their existence so that they be preserved.

* You are entitled to have information about your case which your Attorney can provide.

Your Attorney will make personal contact with you when they have important information to discuss or need to work with you in preparation for your trial. Their job does not include visiting you in the jail to keep you company or acting as a messenger service to outside contacts.

ABSENTEE VOTING

All registered voters in Indiana are eligible to vote absentee-in-person at the county election board satellite office beginning 28 days before Election Day.

May 21, 2024: First day a voter may file an absentee ballot application with a county election board to vote in the general election.

Absentee by Mail Voters are now required to provide identification information by either:

  1. Providing IN Driver License/IN ID Card Number, Unique Voter Registration Number, or Last 4 digits of Social Security Number. One of these numbers must match the number used when registering to vote.

  2. Submitting a photocopy of your valid IN Driver License/IN ID Card or other form of ID that complies with Indiana Voter ID Law.

All completed applications must be received and approved in the Election Office by 11:59 p.m., Thursday, October 24, 2024.


Absentee voting by mail is available for anyone meeting one of the following requirements: 

  1. You have a specific, reasonable expectation that you will be absent from the county on Election Day during the entire 12 hours that the polls are open (6 am until 6 pm).
  2. You have a disability.
  3. You are at least 65 years of age.
  4. You will have official election duties outside of your voting precinct.
  5. You are scheduled to work at your regular place of employment during the entire 12 hours that the polls are open.
  6. You will be confined due to illness or injury or you will be caring for an individual confined due to illness or injury during the entire 12 hours that the polls are open.
  7. You are prevented from voting because of a religious discipline or religious holiday during the entire 12 hours that the polls are open.
  8. You are a participant in the state's address confidentiality program.
  9. You are a member of the military or a public safety officer.
  10. You are a voter eligible to vote under the "fail safe" procedures in IC 3-10-11 of 3-10-12.
  11. You are a "serious sex offender" (as defined in IC 35-42-4-14(a)).
  12. You are prevented from voting due to unavailability of transportation to the polls.

In order to vote absentee by mail, go to indianavoters.in.gov or complete the Application for Absentee Ballot (ABS-Mail) found below and mail it to: Vanderburgh County Election Office, P.O. Box 3343, Evansville, IN 47732-3343.

    In order to vote absentee-by-traveling board, one of the following must apply:

    1. The voter expects to be confined, due to illness or injury, or the voter expects to be caring for a confined person at a private residence, on Election Day.

    Laptop Users - NetMotion has been installed on all enterprise laptops - No additional VPN is necessary.  However, make sure to log onto the laptop while it is connected to the network before taking it home. 

    If you have an enterprise laptop no further action is necessary on your part.

    Please note the following before working remotely:

    • You will need to know the name of your work computer.  This should be on a label on the PC.
    • Your enterprise desktop MUST be powered on.  You should restart your PC before leaving, but do not power it down.  You can power off your monitors.
    • The Help Desk will NOT troubleshoot issues with your home device.

    Your supervisor will let you know if you are permitted to work from home during the CoVID-19 health situation.

    Desktop Users - To work from home using a Windows PC you must first install the VPN client.  Once you have installed the VPN client you will then remotely access your Civicnet PC. First, if not already connected, connect the VPN.  Then access your work PC .

    The Evansville Climate Collaborative (formerly known as EPA) responds to open burning and other air emission complaints in its jurisdiction within the City of Evansville.

    Please use the Action Center form to submit your complaint or call (812) 435-6145. Please be as specific and detailed as possible when submitting your complaint. If you complaint needs immediate attention outside of normal business hours (8AM-4:30PM Monday-Friday), please call 911.

    2024 General Election Day Vote Centers

    Previously, a voter was required to vote at the polling place within the precinct they resided. Now, a voter can choose to vote at any Vote Center that is convenient for them.

    On Election Day, November 5, 2024, the polls open at 6:00 AM and close at 6:00 PM.

    Internal Controls - Grant Procedures

    Grant Reporting - Department:

    Step One:

    The Department will submit the grant application to the "Grantor" for approval.

    Step Two:

    Once the Grant application is approved, the grant agreement is sent to the Auditor to be signed.

    Step Three:

    Once the final grant agreement is provided by the "Grantor", the Department will bring the grant to the Auditor's Office for execution.

    Step Four:

    The Auditor's Office will create a file for each grant.

    Step Five:

    The Department must return a copy of the Awards letter, grant agreement, and a New Fund Request to the Auditor's Office. If it is a Federal Grant, a Federal Grant Summary Form must also be submitted.

    Step Six:

    The Department must fill out a Grant Monies Requested Form each time the County is to receive grant funding. The claim vouchers and request for advances supporting the
    distribution should be attached to the form.

    Step Seven:

    A copy of all documents will be kept in their own grant file by fund in the Auditor's Office.


    Grant Reporting in Gateway:

    Step One:

    The Bookkeeper in the Auditor's Office will pull individual grant files and a working spreadsheet for each fund.

    Step Two:

    The Bookkeeper will run reports from our Financial System.

    Step Three:

    Compare financial reports to the Bookkeeper's spreadsheet verifying receipts, invoices, quietus, to make sure they balance.

    Step Four:

    Once the financials are balanced to the grant files, that information is entered into Gateway.

    Step Five:

    After entering everything into Gateway, run a Grant report out of Gateway to insure the balances match to our financial system and the Bookkeeper's detailed spreadsheet.

    Step Six:

    The Bookkeeper's spreadsheet is sent to the appropriate department to verify receipts, disbursements, award numbers, CFDA numbers, and pass through entity information.

    Step Seven:

    The departments will verify all information, and make any corrections if necessary. The Departments will have to INITIAL next to each:

    • Receipt total,
    • Disbursement total,
    • Project Name and Description,
    • Federal Program name and Project Title,
    • Federal Agency,
    • Pass Through Agency,
    • CFDA Number,
    • Award Name,
    • Award Number
    • and Grant Type.

    Step Eight:

    Then the Federal Grants will be submitted in Gateway, and the grant reporting will be completed to the best of the Auditor Office's ability.

    LIFE SAFETY FIRE PROTECTION PLANS

     *  List Occupancy type;

     * List Square Footage of building. If multiple floors please list Square Footage of each floor;

     *  Show total calculated occupant loads for each area and entire building;

     *  Fire and life safety plan showing graphically or by legend the location and rating of building elements such as area separation walls, smoke barriers, fire-resistive corridor walls, stair enclosures, shaft enclosures and horizontal exits. Show number of required exits, exiting travel distances, path of egress to the public way from all exits, emergency lighting and exit signage;

     *  Details/sections of walls, floors and roof, showing dimensions, materials.  Include required exterior openings/access for all stories and basements per Building/Indiana Fire Code section 903.2.10;

     *  Door schedule showing material, size, thickness, fire-resistive rating for all doors and accessible hardware;

     *  Fire protection plans showing type of system, location of sprinkler heads, standpipes, hose connections, fire pumps, riser, and hanger details. Other specific requirements contained in NFPA Standards 11, 12, 13, 13R, 14, 20 as adopted in 675 IAC 13.

    • Include location of Fire Department Connection (5” Storz with 30 Degree Elbow)
    • Include Knox Box (3200 series);

     *  Fire detection and alarm system plans including specific requirements contained in NFPA Standard 72 as adopted in 675 IAC 22;

     *  Kitchen hood plans, cut sheets, and details of any hood suppression system;

     *  High-piled storage plans including commodity type, storage arrangement, usable storage height, clearance between top of storage and fire sprinklers, clearly marked aisles, and the location of various commodities;

     *  Sprinkler Plan Review Worksheet - This worksheet must be completed entirely and submitted with an electronic copy or one (1) hard copy set of the following: sprinkler drawings, hydraulic calculations, and complete manufacturer’s “cut sheets” for all sprinkler components, including piping, sprinkler heads, etc. Failure to supply all the required information will delay the review of the plans. Please provide to Evansville Fire Department.

     *  Fire Alarm Plan Review Worksheet - This worksheet must be completed entirely and submitted with an electronic copy or one (1) hard copy set of the following: fire alarm drawings, system components, and complete manufacturer’s “cut sheets” for all fire alarm components, including detectors, notification devices, etc. Failure to supply all the required information will delay the review of the fire alarm application of fire alarm plans. Please provide to Evansville Fire Department.

    • Certificate of Occupancy: After final approval inspections have verified code compliance and structure passes the Evansville Fire Department Final Inspection Checklist, the Building Commission will issue a Certificate of Occupancy. The building may not be occupied before the Certificate of Occupancy is issued.

    The Evansville Climate Collaborative (ECC) enforces air quality regulations governing open burning in its jurisdiction within City of Evansville limits.  

    All open burning requires advance approval from ECC within the city limits.  Most open burning within ECC jurisdiction requires advance approval from ECC. 

    Most open burning may also require approval from the Indiana Department of Environmental Management. 

    Please contact us in advance for burning rules and approvals, allowing plenty of time for a response considering business hours of operation. 812-435-6145 or climate@evansville.in.gov.

    Open burning is not permitted during burn bans, air quality / ozone alert days, or during adverse weather (high winds, drought, etc.). 

    Burn bans are issued by the responding fire department in your area, and you can contact them for the latest updates.  Fire Departments do not have authority to give approval for open burning.
