Block-By-Block is a neighborhood cleaning effort between the City of Evansville and community organizations the aim of which is to beautify the neighborhood and engage residents with the community. 1. I understand that I must abide by all rules, regulations, and instructions of the City of Evansville, including its officers, employees, agents, contractors, and volunteers (collectively, the “Sponsor”), during the activity described above and all related transportation (the “Activity”). 2. I understand and agree that I am choosing to participate in the Activity of my own free will. 3. I accept and voluntarily incur all risks of any injuries, damages, or harm which arise from, during or as a result of my participation in the Activity. In consideration of the advantages of the Activity, I agree to and do release, indemnify, defend, hold harmless and forever discharge Sponsor from any and all claims, causes of action, losses, liabilities, or damages which might be asserted or claimed for any loss of property, personal injury or death arising out of or in any way related to the Activity, including Sponsor’s negligence, mistake, or failure to supervise, or any negligence of a third party unless it results solely from Sponsor’s willful misconduct. Should any claim, cause of action, or demand be made against the Sponsor arising out of or relating in any way to my participation in the Activity (other than resulting solely from Sponsor’s willful misconduct), whether asserted by me or any other person or entity, I will indemnify, defend, and hold harmless Sponsor, from any such claim, cause of action or demand and any resulting liability, including reasonable attorneys’ fees, expenses and costs. 4. I understand and agree that Sponsor is not responsible for any lost, stolen, or damaged property during my participation in the Activity. 5. I understand that, in the event of a medical emergency threatening my life or limb, informed consent is not required for my treatment and that medical care will be obtained and rendered to me. BY SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THIS AGREEMENT.
